legal terms this is known as "Vicarious Liability."
Pennsylvania law also requires hospitals to select and retain only the
most competent doctors and to oversee all those who practice medicine
with its walls.
Hospitals must also formulate, adopt and enforce adequate rules to
ensure quality care for its patients. This includes exercising due care
in the maintenance of a safe and adequate facility and provide safe and
adequate equipment. If they fail to do so, it may be a case of
malpractice or negligence.
