Work Place Injuries
If you've been injured on the job you have a right to be compensated
under the Pennsylvania Workers' Compensation Act. An injured worker is
entitled to compensation for medical expenses as well as loss of income.
Benefits for a work related death are also available.
To seek
a Workers' Compensation claim, you must be injured while acting within
the course and scope of your employment.
Benefits are typically paid by private insurance companies or directly by the employer. Benefits are usually about two-thirds of the
injured person's pre-injury wage. Workers' Compensation benefits are
tax-free.
Special
benefits are payable when the injury is severe enough to cause the
employee's death. Other special benefits are payable when a person has
suffered a permanent loss such as being rendered blind or deaf or having
suffered an amputation.
Work Related Disease
If you or a loved one has suffered from an disease contacted during your
employment (an example would be Black Lung disease from working in a
coal mine), then the disease and inability to work must occur within 300
weeks from the date you were last employed in the job where you
contracted the disease. Also, a petition to have a case brought must be
filed no later than three years from the date of injury or disability.
Report Your Injury or Illness Right Away
One of the keys to a successful Workers' Compensation filing is to
notify your employer of a work related injury or illness as soon as
possible. Notice that an injury has been suffered must be provided to a
supervisor at your place of employment within 120 days of the date of
injury. Failure to make such a notification can result in a claim being
denied.
Don't Be Pressured By An
Insurance Company
Do not allow yourself to be pressured to sign away your Workers'
Compensation claim by an insurance company. In fact, never sign any
insurance document until the document has been reviewed by a Lenahan &
Dempsey lawyer.
The same goes for medical testing being urged by an insurance company.
Without realizing it, by cooperating with an insurance company you may
be waiving some very important legal rights.
