- Attorney Timothy Lenahan

Medical malpractice, in all of its forms, is a highly complex area of the law practiced at Lenahan & Dempsey.

We know that thousands of innocent patients are harmed each year in cases involving doctors, surgeons, nurses, hospitals, nursing homes and long term care facilities. Each year our lawyers offer advice to many such injured patients or their families.

We could never address all of the various forms of malpractice by medical professionals or institutions in the space allotted here. The information below can only serve as a starting point in any discussion of medical malpractice.

Malpractice by a Medical Professional

Not every physician, nurse or other medical provider offers the same high standards of care. When a medical professional fails to maintain accepted standards of care, it could be a case of medical malpractice.

There are also circumstances where a well intentioned physician or nurse may make a serious mistake while rendering care or in misdiagnosis of a serious ailment or injury. Should this care result in a serious injury or death, it may be a case of medical malpractice.

Malpractice by a Hospital, Nursing Home or Long Term Care Facility

In Pennsylvania, there are numerous circumstances where a hospital or other health care facility may be liable for malpractice for negligent acts of its employees or those acting on behalf of an institution. In legal terms this is known as "Vicarious Liability."

Pennsylvania law also requires hospitals to select and retain only the most competent doctors and to oversee all those who practice medicine with its walls.

Hospitals must also formulate, adopt and enforce adequate rules to ensure quality care for its patients. This includes exercising due care in the maintenance of a safe and adequate facility and provide safe and adequate equipment. If they fail to do so, it may be a case of malpractice or negligence.
