Restarting/Reinstating Your Claim
Many injured workers find they need to restart or reinstate their claim due to problems arising from their original work-related injury or illness. This process is known as a Petition to Reinstate Workers’ Compensation Benefits.
This process can begin under several circumstances including, but not limited to:
1. If an injured worker experiences a worsening in their work-related medical condition negatively impacting their ability to work and/or receive additional medical treatment, it may trigger a worker’s eligibility to have Workers’ Compensation benefits reinstated.
2. Failure of the injured worker to comply with the requirements of their workers' compensation claim. Examples would be not attending medical appointments or participating in vocational rehabilitation. However, if the worker can show a valid reason for their non-compliance, they may be able to have their benefits reinstated.
3. If an injured worker has returned to modified-duty work and is still suffering the work injury and then loses their job through no fault of their own, then they may be eligible to have their benefits reinstated.
