IRE stands for Impairment Rating Evaluation.
Note: Workers’ Compensation law in Pennsylvania is highly complex with many nuances. The section below is a general description to help you understand the basics of IRE’s (Impairment Rating Evaluations). For specific questions on your individual circumstances and your individual Workers’ Compensation Claim, please call us at 1.888.536.2426 so we can provide you with the most accurate information possible.
IRE’s are another of the often confusing alphabet of Workers’ Compensation. IRE stands for Impairment Rating Evaluation.
An IRE is an examination requested by the employer or its insurance company but conducted by a State-appointed physician to assess an injured party’s whole body impairment after an injury and after a person has been out of work for more than 104 weeks.
Understanding The IRE Percentage Rating
Pursuant to the American Medical Association guidelines applying to Pennsylvania Workers’ Compensation cases, the IRE will designate a Whole Body Impairment percentage based upon the accepted work injuries. A determination of a Whole Body Impairment less than 35% will cap a receipt of future Workers’ Compensation benefits. Such a cap can artificially limit how long you can receive future Workers’ Compensation benefits.
IRE Disputes
At Lenahan & Dempsey, we are dedicated to fairly reviewing Impairment Rating Evaluations. We are also connected with experts who will conduct their own review of the Impairment Rating Evaluation to verify if it is valid.
If our expert were to disagree with the IRE percentage findings, then Lenahan & Dempsey would file a Petition To Review to challenge the IRE before a Workers’ Compensation Judge. Lenahan & Dempsey will represent you and fight for your rights.
