Fetal Distress

Fetal distress refers to a serious condition where the fetus shows signs of distress, either during the pregnancy or during labor.   Some common causes are reaction to medications administrated to the mother, issues with the umbilical cord or the placenta and more.

Some common symptoms of Fetal Distress include a low or high fetal heartbeat, reduced fetal movement in the womb and signs of low amnionic fluid, the fluid that protects the unborn baby during pregnancy.

Fetal Distress can often lead to an unplanned Cesarean Section, a surgical procedure to remove the baby from the womb.  The operation is known by its more common name, C-Section, and the operation itself can cause injuries to the baby and the mother.

We Can Help

Your delivery team is supposed to closely monitor both the mother and unborn baby for signs of fetal distress throughout the pregnancy.

At Lenahan & Dempsey, we understand the standards of care medical professionals are required to provide to monitor for and help alleviate fetal distress.

In Pennsylvania, if fetal distress leads to injury or harm to the child or mother, there may be grounds for a medical malpractice or a personal injury lawsuit.

To establish a Fetal Distress Injury claim in Pennsylvania, we must demonstrate several factors, including:

  1. Duty of care - We must show your medical team owed a duty of care to the mother and unborn child.
  2. Breach of duty - The defendant(s) breached this duty through negligent actions or failures to act to current medical standards.
  3. Causation - The breach of duty caused or increased the risk of harm or injury suffered by the mother or child.
  4. Damages - The plaintiff suffered actual damages because of the defendant's actions.

Possible Compensation

Compensatory damages in Fetal Distress cases can include medical expenses, lost wages, pain and suffering and loss of enjoyment of life for the injured child, and long-term care costs for the injured child or mother. In cases where the child suffers long-term disabilities due to fetal distress, the compensation awarded may be substantial to cover life-long medical and care needs.
