Heart Attacks

Heart Attacks and Medical Malpractice

Heart Attacks, also known as myocardial infarctions, are a leading cause of death in Pennsylvania. Thousands of state residents suffer from heart attacks every year, with many requiring immediate medical care to prevent further damage to the heart muscle and improve their chances of survival.

Sadly, sometimes these victims of heart attacks are either denied treatment or see their treatment delayed.  In some cases, heart attack signs are ignored or misdiagnosed, a situation experienced by many people who may not fit a traditional heart attack profile.

Studies show some women who are treated in emergency rooms do not have their heart attacks properly diagnosed.

Poor care, improper care, or no care at all can lead to preventable heart muscle damage, or even death.

We can help.

Heart Attack Symptoms

According to researchers at the Mayo Clinic, while there are some common threads among those who suffer a heart attack, some people do not experience any symptoms at all.

For those who do have symptoms, many people suffer common symptoms including but not limited to:

  • Chest pain that may feel like pressure, tightness, pain, squeezing or aching feeling
  • Pain or discomfort that spreads to the shoulder, arm, back, neck, jaw, teeth or sometimes the upper belly
  • Cold sweat
  • Fatigue
  • Heartburn or indigestion
  • Lightheadedness or sudden dizziness
  • Nausea
  • Shortness of breath

Women may have symptoms that include but are not limited to, brief or sharp pain felt in the neck, arm or back.

All of us are well advised to be aware of our bodies and be on the lookout for anything out of the ordinary.   At the first sign of a problem, get yourself to an emergency room as quickly as possible.

Heart Attacks and Medical Malpractice

Medical malpractice happens when a physician, nurse, or other healthcare provider deviates from the normal standard of care that is generally accepted in the medical community, resulting in harm to you or a loved one.

To establish a claim for medical malpractice based on a delayed or incorrect diagnosis/treatment, we must show your healthcare providers failed to properly diagnose in a timely manner, and that this failure contributed to or increased harm to you or a loved one.

Critical Elements To Be Considered In Any Medical Malpractice Case

  1. Duty of care – This is very important in Failure to Diagnose or Delayed Diagnosis cases.    We must show the doctor and medical team owed a duty of care to you or your loved one.
  2. Breach of duty -  We must show your doctor and medical team failed to uphold the expected standard of care by either failing to diagnose the condition within a reasonable amount of time or making an incorrect diagnosis.
  3. Causation - This is when the delayed or incorrect diagnosis caused or increased the risk of harm to the patient. This can include worsening of the patient's condition, the need for more invasive treatment, or a reduced chance of recovery.
  4. Damages - We will be required to show you or your loved one suffered damage because of the delayed or incorrect diagnosis/treatment. These damages can include physical pain, emotional suffering, loss of enjoyment of life, additional medical expenses, loss of income, or a worsened prognosis.

Statute of Limitations

The statute of limitations to file a medical malpractice action is two years, but it can be difficult to determine when the statute of limitations begins to run in these cases, which often requires a complete analysis of all of the facts and circumstances.

If you feel you or a loved one has been a victim of medical malpractice involving a heart attack, it is important to call our office quickly for a consultation so you do not lose your right to sue based upon time limits.
